Warranty / Refund Policies
Service, repair, shipping and any type of labor charges are non-refundable once performed.

Labor and Service Warranty – Bay Business Edge, Inc. offers a 30 day service warranty.  All labor and service is backed by our 30 day Guarantee. If the same exact problem reoccurs within 30 days of the original repair we will come back and fix it at no charge unless the problem is the result of Client negligence, Virus, Spyware or incorrect usage. No refunds on any service, repair, labor, shipping or other non-parts charge.

Parts Warranty – 30 day warranty on parts purchased from and installed by Bay Business Edge, Inc.  If an item is defective we will exchange with the same item within 30 days of purchase date.  If an item is out of stock, customer will need to wait for back-order of product. Bay Business Edge, Inc. may replace it with a product of equal or similar features and functionality, under special circumstances. 

 

Cancellation Policies
Service Cancellation - Cancellation requests must be made in written form to Bay Business Edge, Inc. either by email, mail or fax. Cancellation requests must include customer account number and contact name.

 

Bay Business Edge, Inc. reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by Bay Business Edge, Inc. to the customer. Any violation of policies which results in extra costs will be billed to the customer (i.e. transfer, space etc.) We reserve the right to refund a prorated amount or no refund at all. 

 

Payment Policies
Payment is due immediately. Payment-due notices will be sent by mail, unless otherwise requested by client. If Website Hosting payment is not received by the due date, your account will be terminated. Once your account is terminated, you will need to pay for the set up fee ($25) and the monthly fees to reopen the account. There is a $35 fee for bounced checks and a $10 processing fee for chargeback’s.

 

Data Backup Policy
Client agrees to bear full responsibility for all data backup prior to any repair or service of computer hardware; software or other equipment by Bay Business Edge, Inc. Client hereby indemnifies Bay Business Edge, Inc. from any claim or liability related to data loss for any reason whatsoever.

 

Estimates
The price estimate to the client is for the work agreed on the estimate only. Should the client decide that changes are required after work on the estimate commences, then we will accept these changes with the provision that additional charges will be added to the estimate at the current hourly rate.

 

Copyrights and Trademarks
The client represents to Bay Business Edge, Inc. and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Bay Business Edge, Inc. for inclusion in web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Bay Business Edge, Inc. from any claim or suit arising from the use of such elements furnished by the client.

Certain images provided by Bay Business Edge, Inc. for the construction of the website may have been purchased under license from stock image suppliers. These images are generally only licensed for use on a single website and may not be used in publicity material. The Client is legally responsible for ensuring that this does not happen. If you wish to use any images from the site for other purposes please contact us for clarification.

 

Web Design Project Copyright
Copyright to the finished web design site produced by Bay Business Edge, Inc. will be owned by the web designer and/or Bay Business Edge, Inc. The Client will be assigned rights to use the Web Design Project as a web site, once final payment under this agreement and any additional charges incurred have been paid. Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the Client, and remain the property of their respective owners. Bay Business Edge, Inc. and its subcontractors retain the right to display graphics and other web design elements as examples of their work in their respective portfolios. All Web Design Projects will contain a copyright/legal statement with a link to a Bay Business Edge, Inc. website.

 

Copyright Complaints
Bay Business Edge, Inc. and its affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, email us with your complaint.

 

Late Payment
Accounts that have not been settled within 7 days of our final reminder will incur a late payment charge of 10% of the amount outstanding. This late payment charge will be added monthly until account is settled.


Specific Acceptable Use Policies
Server abuse - Any attempt to undermine or cause harm to a server, or client, of Bay Business Edge, Inc. is strictly prohibited. Unauthorized use of other people's accounts or computers - We will strongly react to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include "internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning etc. Any unauthorized use of accounts or computers by a Bay Business Edge, Inc. client, whether or not the attacked account or computer belongs to Bay Business Edge, Inc., will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.

Spamming - Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Spamming on other servers which in turn contain links to a domain on our network is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and E-mail. If you are found to have spammed, we will contact you to resolve the situation. If it is a severe case then we will immediately, without warning, disable your domain until the situation is resolved. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy. As such, any violation will result in immediate deactivation of services without refund. In addition any site selling or promoting bulk e-mail services is not allowed.

Server Resources - Any web site that uses a high amount of server resources (such as, but not limited to CPU Time, Memory Usage, and Network Resources) will be given an option of either upgrading their service level or reducing the resource used to an acceptable level.


Refusal of Service
Bay Business Edge, Inc. reserves the right at its sole discretion to refuse or cancel service. Violation of any Rules and Regulations could result in a warning, suspension, or possible account termination. Accounts terminated due to policy violations will not be refunded.



Indemnification
Client agrees that it shall defend, indemnify, save and hold Bay Business Edge, Inc. harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Bay Business Edge, Inc. its agents, its clients, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by client, it's agents, employees or assigns. Client agrees to defend, indemnify and hold harmless Bay Business Edge, Inc. against liabilities arising out of; (1) any injury to person or property caused by any products sold or distributed in association with Bay Business Edge, Inc. services; (2) any material supplied by client infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to client from Bay Business Edge, Inc. services.

Bay Business Edge, Inc. will not be responsible for any damages your business may suffer. Bay Business Edge, Inc. makes no warranties of any kind, expressed or implied for services we provide. Bay Business Edge, Inc. disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Bay Business Edge, Inc. and its employees. Bay Business Edge, Inc. reserves the right to revise its policies at any time. Failure to follow any terms and conditions may result in account deactivation.
